If you want to employ a member of staff from outside EEA (European Economic Area), you need a sponsor licence to provide evidence that the migrant worker has a genuine job in the UK. It also acts as a pledge from you, the sponsor, that you will accept the responsibilities of sponsorship.
The Tier 2 (General) category of the Points Based System is designed for skilled workers with a job offer to fill a gap in the workforce that cannot be filled by a settled worker in UK. Similar to the other areas of the Points Based System, Tier 2 is an employer led process.
The Tier 2 Intra Company Transfer category of the Points Based System is designed for employees of multinational companies who wish to be transferred to a UK branch of the organisation, either on a long term basis or for frequent short visits.

The Home Office have indicated that they will want to do either a pre or post licence application review of the HR systems and processes. In most cases these audits by the Home Office are unannounced and if an employer is not prepared or does not have the requisite procedures in place it could lead to the Sponsor Licence being revoked and any Tier 2 visas for their employees being curtailed.
